Comprehensive Zoning Analysis

Each applicant must be compliant with both state and local zoning restrictions. The state imposes a six-hundred foot buffer between a cannabis operation and a k-12 school or youth center, but defers to local municipalities to implement their own zoning restrictions. Many jurisdictions impose a wider radius with regards to schools and youth centers, or include buffer zones for libraries and parks. If an applicant’s proposed property is not properly zoned, the applicant will not be successful in obtaining a permit.

Many jurisdictions evaluate applications on a point scale, and so it is important to depict the proposed site in the most favorable light. A strong narrative, aerial diagrams marking things like access to public transportation, nearest residential zone, and existing cannabis businesses, as well a legally accurate parcel description combine to make the strongest application from a zoning standpoint.
